His explanation for why he wouldn't pursue the case was based on the number of documents found that were marked classified. Sounds great, but she signed an NDA on her first day in office acknowledging that classified materials in her possession did not have to be marked as such (because she was capable of creating classified documents using only her own knowledge), and any improper handling of classified documents (marked or unmarked) is a felony.
The point isn't that Clinton did this exact thing. The point is she did it, confessed to it, and was never charged with felonies under New York law. Which is why Trump being charged is clearly lawfare.
What's sobering in this interesting argument, ends in jovial laughter on the incredibly serious issue of such a deep level of systemic corruption, revealing an even more foundational demonstration of the privilege of the participants on both sides of the desk. If you want to present yourself as good as possible to voters… you're going to get a haircut, you're going to buy a nice suit, you'll make lots of personal expenses to present yourself positively to the voters. None of those are considered election expenses. If he would have made a "hush money" payment when he was not running for office, then a payment made during an election doesn't automatically turn it into an election expense.
